1. Agreement to these terms
These Terms of Service (“Terms”) form a binding agreement between you and Rumiby concerning your access to and use of rumiby.com and the related features, content, and services (collectively, the “Services”).
By accessing or using the Services, creating an account, publishing a listing, submitting an agent application, or sending an inquiry, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, publish a listing, apply for an agent profile, or use the Services for a housing transaction. If you use Rumiby for a company or other organization, you represent that you have authority to bind that organization to these Terms.
You must provide accurate, current, and complete information; keep your credentials confidential; and promptly update information that changes. You are responsible for activity under your account and must notify us promptly if you suspect unauthorized access. You may not impersonate another person, create an account using information you are not authorized to use, or transfer an account without our permission.
3. Rumiby’s role
Rumiby provides tools that allow users to publish and discover property information, save favorites, find professional profiles, and communicate about properties. Users—not Rumiby—control the properties, listings, communications, offers, screening decisions, and transactions in which they participate.
Rumiby does not guarantee that a property is available, lawful, safe, habitable, accurately described, appropriately priced, or suitable for any purpose. Rumiby does not set transaction terms, hold deposits, verify funds, conduct inspections, provide title services, or make lending or housing decisions. A search result, recommendation, badge, estimate, or profile is informational and is not professional advice or an endorsement.
Users should independently verify material facts and consult qualified real estate, legal, tax, financial, inspection, insurance, and other professionals before making a decision or transferring money.
4. Listings and user responsibilities
If you create, claim, manage, or promote a listing, you represent and warrant that:
- You are authorized to advertise the property and provide its content.
- The listing is accurate, current, lawful, and not misleading.
- You have all rights and permissions required for photos, descriptions, addresses, and other materials.
- You will promptly correct errors and mark a property unavailable, sold, rented, or inactive when appropriate.
- The listing and your conduct comply with housing, advertising, licensing, privacy, intellectual-property, and other applicable laws.
- You will clearly disclose material conditions, fees, restrictions, and your professional or ownership relationship to the property when required by law.
Rumiby may edit formatting, request supporting information, reject, remove, limit, or reclassify a listing, or display warnings when we reasonably believe doing so protects users, improves accuracy, enforces these Terms, or complies with law. Rumiby is not obligated to monitor every listing and is not responsible for user-provided content.
5. Agents and verification
Agent profiles may be published only after review by Rumiby. Applicants must submit truthful professional information and maintain every license, registration, insurance policy, disclosure, and authorization required for their activities. Agents must promptly notify Rumiby of a license suspension, expiration, restriction, disciplinary matter, or material change to their profile.
A “verified” label means only that Rumiby reviewed specified information using the process in effect at that time. It is not a guarantee of an agent’s identity, current license status, experience, quality, conduct, availability, or suitability. Users must independently confirm an agent’s credentials with the relevant licensing authority before hiring or relying on that agent.
Unless expressly stated, agents shown on Rumiby are independent third parties. They are not employees, partners, representatives, or agents of Rumiby, and Rumiby is not responsible for their advice or conduct.
6. Inquiries and communications
When you send an inquiry, you authorize Rumiby to deliver the information you provide to the relevant property owner, listing account, or agent. Delivery does not create a brokerage, fiduciary, agency, landlord-tenant, or other professional relationship with Rumiby and does not guarantee a response.
You must communicate truthfully and respectfully. Do not send spam, threats, discriminatory statements, malware, payment credentials, or sensitive personal information. Verify the recipient and property independently. Never send money merely because someone contacted you through Rumiby, and use secure transaction methods and qualified professionals where appropriate.
7. Fair housing and prohibited conduct
Rumiby supports equal housing opportunity. You may not use the Services to discriminate or indicate an unlawful preference, limitation, or exclusion based on race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected by federal, state, or local law. This rule applies to listings, advertising, screening, availability, pricing, communications, services, and transactions.
You also may not:
- Post a false, fraudulent, duplicate, unavailable, or bait-and-switch listing.
- Misrepresent identity, ownership, authorization, credentials, affiliation, fees, property details, or transaction terms.
- Use Rumiby to violate law, commit fraud, launder money, evade sanctions, or facilitate an unsafe or illegal transaction.
- Harass, threaten, stalk, exploit, or invade the privacy of another person.
- Scrape, harvest, copy, index, or commercially exploit the Services or personal information by automated means without written permission.
- Interfere with security, test vulnerabilities without authorization, upload malicious code, overload infrastructure, or bypass access controls.
- Reverse engineer the Services except where applicable law expressly permits it.
- Use Rumiby content or data to train an artificial-intelligence model without written permission.
- Manipulate rankings, reviews, inquiries, verification, engagement, or other platform signals.
Suspected housing discrimination may be reported directly to the U.S. Department of Housing and Urban Development or the appropriate state or local authority. Reporting an issue to Rumiby does not replace a filing deadline or legal remedy.
8. User content and license
You retain ownership of content you submit, including listing text, photos, profile information, and messages (“User Content”). You grant Rumiby a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, format, adapt, publish, display, distribute, and otherwise use User Content as reasonably necessary to operate, secure, promote, and improve the Services. This license lasts while the content is available through the Services and for a reasonable backup, legal, or archival period afterward.
You represent that you own or control the necessary rights to User Content and that our permitted use will not violate another person’s rights or applicable law. You remain responsible for User Content and for maintaining copies you need. Feedback and suggestions may be used by Rumiby without restriction or compensation.
9. Paid features and commercial relationships
Some current or future features may require payment, including professional subscriptions, promoted listings, advertising, enhanced placement, lead-management tools, or transaction-related services. Before charging you, Rumiby will present the applicable price, billing period, features, cancellation method, and any additional terms.
Paid or sponsored placement will be identified and does not guarantee inquiries, engagement, ranking, a completed transaction, or any business result. Organic and paid placement may use different display rules. We may receive compensation from disclosed partners, but compensation does not convert general platform information into professional advice.
Unless specific purchase terms state otherwise, fees are nonrefundable except where required by law. Taxes and third-party charges may apply. Rumiby will not sell personal information as a monetization strategy.
10. Rumiby intellectual property
The Services, including Rumiby’s name, branding, interface, software, design, selection, arrangement, and original content, are owned by Rumiby or its licensors and protected by applicable intellectual-property laws. Subject to these Terms, Rumiby grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Services for their intended purpose. No other rights are granted.
11. Third-party services and links
The Services rely on or may link to third-party services, including mapping, authentication, hosting, storage, professional licensing, and external websites. Rumiby does not control third parties and is not responsible for their content, availability, security, products, services, or conduct. Your use of a third-party service may be governed by separate terms and privacy policies.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, availability, title, noninfringement, merchantability, fitness for a particular purpose, or a particular transaction result.
Rumiby does not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components; that content or public records are complete or current; or that a user, listing, agent, property, price, estimate, recommendation, inquiry, or transaction is genuine, accurate, lawful, safe, or suitable. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Rumiby and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or damages arising from a user, listing, communication, property, or real estate transaction, even if advised that such damages are possible.
To the fullest extent permitted by law, Rumiby’s aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid directly to Rumiby during the twelve months before the event giving rise to the claim or US $100. These limitations do not exclude liability that cannot lawfully be excluded or limited.
14. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Rumiby and its officers, employees, contractors, affiliates, and service providers from claims, liabilities, losses, damages, judgments, and reasonable legal fees arising from your User Content, listings, professional or transaction activities, violation of these Terms or law, or infringement of another person’s rights. Rumiby may control the defense of a covered claim, and you agree to cooperate.
15. Suspension and termination
You may stop using the Services at any time. Rumiby may investigate, restrict, suspend, or terminate access; remove content; withhold or revoke verification; or take other reasonable action if we believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if action is needed to protect the Services or others.
Provisions that by their nature should survive termination—including ownership, licenses already necessary for archival or legal purposes, disclaimers, liability limits, indemnification, and dispute provisions—will survive.
16. Disputes and applicable law
Before filing a formal claim, you and Rumiby agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to the contact address below. This requirement does not prevent either party from seeking urgent injunctive relief or using a government complaint process.
These Terms are governed by applicable United States law and the law that applies to Rumiby’s operating entity, without regard to conflict-of-law principles. Any court proceeding must be brought in a court with lawful jurisdiction over the parties and dispute. Nothing in these Terms waives a nonwaivable consumer right or remedy. These Terms do not currently require arbitration or waive participation in a class action.
17. Changes to the Services or these terms
We may add, modify, suspend, or discontinue features. We may update these Terms to reflect changes to the Services, law, security, or business practices. The revised Terms will be posted here with an updated date. We will provide additional notice of material changes when required by law. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
18. General provisions
These Terms and policies expressly incorporated into them constitute the entire agreement concerning the Services. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Rumiby may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Services.
Headings are for convenience only. “Including” means “including without limitation.” Electronic communications and notices satisfy written-notice requirements to the extent permitted by law.
